These Terms of Use ("Terms") are a binding agreement between you and The Solutions Company LLC ("Company," "we," "us," or "our"). By accessing or using thesolutionscompanyllc.com, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the website.

1. Eligibility and Authority

You must be at least 18 years old and legally able to enter a contract. If you use the website for a business or entity, you represent that you have authority to bind it.

2. Website Purpose

The website provides information, educational content, quizzes, support tools, and access to Company services. Website content is general and is not a promise that you qualify for a service, credit product, approval, limit, rate, or result. A quiz result is an educational readiness indicator, not underwriting, a credit decision, or an offer of credit.

3. Separate Service Agreements

Paid services are governed by the service agreement, disclosures, authorizations, payment terms, and cancellation notices presented during enrollment. If a service agreement conflicts with these Terms about that paid service, the service agreement controls, except that no agreement limits a nonwaivable legal right.

4. What We Are - and Are Not

The Solutions Company LLC provides business-foundation assistance, credit education and optimization support, funding-readiness analysis, and capital-strategy guidance. Our funding strategy currently focuses on helping qualified businesses prepare to pursue 0% introductory-APR business credit-card opportunities.

We are not a lender, bank, card issuer, credit bureau, consumer reporting agency, law firm, accounting firm, tax adviser, or registered investment adviser. We do not make credit decisions, issue cards, extend credit, promise approvals, or control a lender's or issuer's underwriting.

5. No Guarantees; Responsible Use

No approval, funding amount, credit limit, interest rate, promotional period, credit-score increase, account deletion, business outcome, filing approval, or completion date is guaranteed. Outcomes depend on your profile, conduct, documentation, third parties, markets, issuers, bureaus, creditors, and other factors outside our control.

You must provide complete and truthful information. Do not submit a false dispute, false identity-theft claim, altered document, synthetic identity, credit privacy number, or misleading application information. We may refuse or stop service when information appears false, incomplete, unlawful, or inconsistent with responsible credit use.

6. Applications and Financial Decisions

You are responsible for deciding whether to apply for or use any financial product and for reviewing the issuer's current terms. Applications may cause hard inquiries, require a personal guarantee, affect personal or business credit, and create repayment obligations. Promotional rates expire and may be lost after default or other events described by the issuer. You should borrow only what your business can responsibly repay.

7. Accounts, Forms, and Submissions

You agree that information submitted through the website is accurate and that you have the right to provide it. Do not upload malware, confidential information belonging to another person, or sensitive data through a general form unless requested through an approved secure channel. You grant us a limited right to use submitted information to respond to you, provide requested services, operate the website, and comply with law, as described in our Privacy Policy.

8. Electronic Communications and SMS

You consent to receive electronic records and transactional communications at the contact information you provide. If you separately opt in to marketing SMS, message frequency varies, message and data rates may apply, and consent is not a condition of purchase. Reply STOP to opt out or HELP for help. Carriers are not liable for delayed or undelivered messages. You are responsible for keeping your contact information current.

9. Payments, Refunds, and Cancellations

Prices and payment timing are disclosed at enrollment and in the applicable service agreement. Our Refund & Cancellation Policy is incorporated into these Terms. Credit-services payments and performance timing remain subject to federal and state law. Nothing in these Terms waives a three-business-day or other nonwaivable cancellation right.

10. Third-Party Services and Affiliate Links

The website may link to or integrate third-party forms, payment processors, credit-monitoring services, scheduling systems, analytics tools, and financial institutions. Third parties control their products, terms, privacy, security, availability, fees, and decisions. We are not responsible for their acts or omissions. Some links, including IdentityIQ links, may be affiliate links; see our Affiliate Disclosure.

11. Acceptable Use

You may not:

Use the website for fraud, deception, unlawful credit activity, unauthorized access, harassment, or infringement.
Interfere with website security, probe vulnerabilities, introduce malware, scrape the website at scale, or bypass access controls.
Impersonate another person, misrepresent authority, or submit information without permission.
Copy, resell, publish, distribute, or create derivative commercial products from our content except with written permission.
Use Company content or marks to imply sponsorship, approval, lender status, or a relationship that does not exist.

12. Intellectual Property

The website, brand elements, text, graphics, tools, methods, course materials, and other content are owned by or licensed to The Solutions Company LLC and are protected by applicable intellectual-property laws. The Solutions Business Foundation, The Funding Foundation, The Funding Blueprint, and associated branding may be Company marks. We grant you a limited, revocable, nonexclusive right to use the public website for personal or internal business evaluation only.

13. Disclaimers

TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEBSITE AND PUBLIC CONTENT ARE PROVIDED 'AS IS' AND 'AS AVAILABLE.' WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR SUITABLE FOR YOUR PARTICULAR PURPOSE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME OF THIS SECTION MAY NOT APPLY TO YOU.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY AND ITS OWNERS, PERSONNEL, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, LOST PROFITS, LOST DATA, LOST OPPORTUNITY, CREDIT DENIALS, OR THIRD-PARTY DECISIONS ARISING FROM THE PUBLIC WEBSITE. LIABILITY RELATING TO A PAID SERVICE IS GOVERNED BY THE APPLICABLE SERVICE AGREEMENT. THESE LIMITATIONS DO NOT APPLY WHERE PROHIBITED BY LAW.

15. Governing Law and Disputes

Texas law governs these Terms, without regard to conflict-of-law principles. A paid-service dispute is governed by the dispute-resolution clause in the applicable signed service agreement. For a website-only dispute not governed by a service agreement, the parties will first attempt good-faith informal resolution. Any court proceeding must be brought in a court of competent jurisdiction in Texas, unless applicable law requires otherwise.

16. Suspension and Termination

We may suspend or terminate access to the website or a feature if we reasonably believe it is being used unlawfully, fraudulently, insecurely, or in violation of these Terms. Provisions that by their nature should survive termination will survive.

17. Changes and General Terms

We may revise these Terms by posting an updated version and date. Continued use after the effective date means you accept the revised Terms. If any provision is unenforceable, it will be modified to the minimum extent necessary and the remaining provisions will continue. Our failure to enforce a provision is not a waiver.
